This is a lawsuit filed in Memphis, Tennessee, by the Receiver against Memphis attorney, Mark Talley, for his role in facilitating the Microfund/Luxor fraudulent program. The Complaint, which can be viewed below, alleges legal malpractice and other theories.

On March 7, 2001, the Court issued an Order requiring the Receiver to prepare a litigation budget for this case. On April 5, 2001, the Receiver submitted his Litigation Budget, which can be viewed below. On April 16, 2001, the Court issued an Order regarding the budget.

After the Receiver filed the lawsuit against Mark Talley, his malpractice insurance carrier filed suit against him to declare his insurance void because it was procured by misrepresentation. Talley failed to defend the case so judgment was entered against him that his insurance was void. He then filed bankruptcy. Accordingly, the Receiver decided this case was no longer worth pursuing and the case has been dismissed.
