This is a lawsuit by the Receiver against the ex-wife of David Gilliland. Records available to the Receiver reflect that she received at least $263,190.00 of funds traceable to funds submitted by defrauded investors. Ms. Gilliland has filed an Answer denying liability. Both parties have consented to proceed before a magistrate judge and the case has been assigned to Judge Kaplan for further handling. On September 18, 2001 the Court issued an Order Requiring Attorney Conference and Joint Status Report. On October 19, 2001 the Joint Status Report was submitted. On October 24, 2001 the Court issued an Initial Scheduling Order. On January 17, 2002, the Receiver filed a Motion for Summary Judgment which was granted by the Court as reflected by the Court's Memorandum Opinion and Order dated March 6, 2002, and the Court's Judgment of March 6, 2002. The Receiver is now in the process of collecting on the judgment. |
